Tips on Completing the EEO-1 Survey

The deadline for the EEO-1 survey has been extended by the Equal Employment Opportunity Commission (EEOC) to June 21, 2022. Employers should be aware of key details regarding this HR compliance form, including instructions on completion and the revised deadline.

What Is the EEO-1 Form?

The EEO-1 survey, also known as the EEO-1 Component 1 report, is a mandatory annual data collection. Private-sector employers with 100 or more employees and federal contractors with 50 or more employees meeting specific criteria must submit demographic workforce data. This includes information on race/ethnicity, sex, and job categories, all of which is kept confidential.

The EEOC, responsible for enforcing federal anti-discrimination laws, prohibits discrimination based on various factors such as race, color, religion, sex, national origin, age (40 or older), disability, or genetic information. The EEOC investigates discrimination charges and seeks resolution through settlements. If an agreement is not reached, the EEOC may file lawsuits on behalf of individuals or the general public. Additionally, the organization conducts outreach programs to prevent future cases.

How to Fill out the EEO-1 Form

The first page is divided into three sections:

Section A: Here you will specify the nature of the report you are submitting—whether for a single establishment or for a multi-establishment employer. In the context of EEO-1 reporting, a multi-establishment employer refers to any organization operating at multiple physical locations. If this pertains to your organization, you must also specify the total number of reports being submitted. Essentially, this entails completing a report for each location, mirroring the process outlined in the OSHA Form 300.

Section B: This section requires you to provide fundamental details about your company, encompassing the name, address, location, and employee identification number (EIN). Additionally, you will specify whether your organization submitted an EEO-1 report in the preceding year.

Section C: This section guides you in determining whether your company is obligated to submit the EEO-1 report. Respond to three Yes or No questions; if at least one of your answers is affirmative, it is imperative to complete the remaining sections of the form.

Section D: Here, you will document employment data, constituting the primary information sought by the EEOC from employers. The reporting chart is segmented into several components: Job Categories, Number of Employees by Race/Ethnicity, and Total Combined Employees per category, per Race/Ethnicity. It is essential to report all permanent full-time and part-time employees, along with apprentices and on-the-job trainees, unless specified otherwise. Employers are required to gather demographic information from employees, which should be self-reported. This data can be collected during onboarding or through an anonymous survey, enabling employees to self-identify their race and ethnicity.

Section E: In this section you will provide a concise description of your organization’s core business function and activities. For instance, if you operate a women’s fashion boutique, your primary business function would be outlined as a retail clothing store.

Section F: Section F provides you with a chance to explain any significant alterations in reporting compared to the preceding year. For instance, if there were substantial employee layoffs in 2021, you would document this information in Section F.

Section G: In the final section, you will essentially confirm the accuracy and truthfulness of all information submitted in the form. Subsequently, you will affix your signature and furnish additional personal details for verification purposes.
